Introduction and Acceptance
These Terms & Conditions (“Terms”) govern your access to and use of the YES Awards website and your participation in the YES Awards programme (the “Programme”). By accessing our website or submitting a nomination, you agree to be bound by these Terms. If you do not agree, you should not use the website or participate in the Programme.
About Us
The YES Awards and this website are operated by YES Events FZE LLC, a free zone company registered at SPC Free Zone, Sharjah, United Arab Emirates (the “Company”, “we”, “us” or “our”).
Definitions
- “Nominator” means a person who submits a nomination.
- “Nominee” means the young person put forward for recognition.
- “Content” means any text, images, video, documents or other material submitted to or made available through the website.
Eligibility and Nominations
Eligibility criteria for the Programme are published on our website and may be updated between editions. Nominations must be submitted by an eligible Nominator through the official process, and all information provided must be accurate, truthful and lawfully obtained. Where a Nominee is a minor, the consent of a parent or guardian is required. Submitting a nomination does not guarantee selection.
Use of the Website
You agree to use the website only for lawful purposes. You must not: misuse the website or attempt to gain unauthorised access; upload unlawful, infringing, defamatory or harmful content; impersonate any person or misrepresent your affiliation; or interfere with the security or proper functioning of the website.
Submissions and Content Standards
You are responsible for the Content you submit and warrant that you have the right to submit it, that it is accurate, and that appropriate permissions have been obtained — including consent for any image, video or personal information relating to a minor. Content must not infringe the rights of any third party or breach any applicable law.
Intellectual Property and Licence
The website and its content (excluding user-submitted Content) are owned by or licensed to the Company and are protected by applicable intellectual-property laws. By submitting Content, you grant the Company a non-exclusive, royalty-free licence to use, store, reproduce and, where appropriate consent has been given, publish that Content for the purposes of operating, assessing and promoting the Programme. You retain ownership of your Content.
Assessment, Jury Decisions and Awards
Nominations are reviewed through a process that includes assessment by an independent jury. The decisions of the jury and the Company regarding shortlisting, selection and recognition are final. The Company reserves the right to verify information, to request further evidence, and to disqualify or revoke recognition in cases of ineligibility, misrepresentation, misconduct or breach of these Terms. Unless expressly stated in writing, recognition confers no monetary entitlement.
Privacy
Personal data is handled in accordance with our Privacy Policy and our Safeguarding and Child Protection Policy, which form part of these Terms.
Disclaimers
The website and the Programme are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the website or the Programme, including as to availability, accuracy or fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit or goodwill, arising out of or in connection with the use of the website or participation in the Programme. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnity
You agree to indemnify and hold harmless the Company and its officers, employees and agents against any claims, losses or expenses arising from your breach of these Terms or from Content you submit.
Suspension and Termination
We may suspend or terminate access to the website or participation in the Programme, in whole or in part, where we reasonably consider that these Terms have been breached or to protect the integrity of the Programme or the safety of participants.
Third-Party Links and Services
The website may contain links to, or rely on, third-party websites and services. We are not responsible for the content, policies or practices of those third parties.
Force Majeure
We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, disruption to communications, or governmental action.
Changes to these Terms
We may amend these Terms from time to time. The current version and its effective date will be published on our website, and continued use constitutes acceptance of the amended Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Sharjah, including the regulations of the SPC Free Zone. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts or authorities of the United Arab Emirates, as applicable. [The precise governing law and forum should be confirmed with legal counsel.]
General
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force. These Terms, together with the Privacy Policy and the Safeguarding and Child Protection Policy, constitute the entire agreement between you and the Company in relation to the Programme. Our failure to enforce any provision shall not constitute a waiver of it. You may not assign your rights under these Terms without our consent.
